The consumer is providing information to Sunsilk India and not to Facebook. 15)All information received from the consumer shall be held in confidence. HUL reserves the right to conterms and conditionst consumers & use information received for its brand communication & product development. 16)The personal information shared with us, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without the consent of the consumer/ participant, other than for the purpose of sending hair care tips to consumers. 17)We implement a variety of security measures to maintain the safety of your personal information when you enter, submit, or access your personal information. 18)We may share the information when we believe its appropriate or necessary to comply with the law, enforce our page policies, or protect ours or others rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses. 19)The Page, page Content, page Code, and any and all copyrights, trademarks, service marks, trade names and all other intellectual property or property rights therein are proprietary to HUL and are owned by HUL and/or its licensors and content providers, and are protected by applicable domestic and international intellectual property laws. 20)HUL reserves the right, at its sole discretion, to change and/ or modify and/ or add and/ or remove any portion of the Page, the Page Content, and the terms and conditions, in whole or in part, at any time and at its sole discretion; whether or not applicable to your use of the Page and/or any part thereof, or to impose new conditions, including but not limited to, adding fees and/or charges for use. HUL may also interact with You for research purposes; through various modes i.e. via including but not limited to newsletters, SMS, telephone call, emails and such other modes as HUL may deem appropriate from time to time, at its sole discretion (‘User Services’). 22)By registering on the Page You agree to receive User Services and undertake to agree and accept with these Terms and Conditions and other relevant terms and conditions, privacy policy and disclaimer of this Page. 23)LIMITATION OF LIABILITY 24)Dispute if any shall be subject to Mumbai Jurisdiction. The aforesaid T&C can be amended by HUL without prior notice.any proceedings in any way relating to or concerning these terms and conditions or any rights, duties, obligations or liabilities arising there under to the exclusion of all other courts in India. SUNSILK Dispensing Machine - Terms and conditons1) Free sampling is valid till the stocks last. 2) HUL is not responsible for non receipt of SMS due to any telecommunication service provider issue or any other kind of technical issue. In such cases, HUL will not be liable to provide free sample against SMS sent by requester. 3) Only 1 unit of 40ml Sunsilk conditioner tube through 1 mobile number can be dispensed against request sent as per the described format on the machine. HUL will not be responsible if SMS received is not as per the described or instructed template. Sample request is Two step process. Step 1: SMS ‘Sunsilk’ to the number featuring on machine and wait for the acknowledgement SMS from Sunsilk. Step 2: Press the most relevent Hair problem button on the machine to receive the Free sunsilk samples post receiving the acknowledgement SMS from Sunsilk. 4) HUL can send the brand relevant communication for next 45 days on the number request from which the sample request is sent. These will supercede the DND subscription by the User. 5) The Request number will not be disclosed to anyone for commercial use nor will be used for any other purpose other than sending product releated tips. 6) The views expressed by the brand on the hair problems and solutions suggestive in nature and HUL does not stay responsible for the views/suggestion/recommendation mentioned in SMS in any manner. The ultimate responsibility of suggestion implication does not lie with HUL. 7) In case of stock out situation, the Free sample will not be dispense. HUL should not stay liable for non dispensing of sample from machine due to unavailability of stock. HUL should also be not responsible to deliver free sample against such SMS later. 8) Dispensing machine will be managed by Digital Signage Network who is appointed as vendor for this project and will take care execution of the project. Any claim related to operations and complaints will need be addressed to Digital Signage Network. 9) HUL will not be responsible sample not dispense due to any kind of technical/operational issue with in machine. 10) The requester will have to press the button within Five minutes from the receipt of the SMS. In case he/she fails to do so, the machine will not dispense the free sample post that. 11) HUL reserves right to block or unblock the number of the requester for repeat request sender for the purpose of sample dispensing in its server for future reference. 12) HUL will not be responsible for the variant of conditioner received by the requester and damaged sample received by the requester. No exchange or replacement will take place against such kind of sample. 13) HUL reserves right to instruct the vendor to withdraw this activity at any point in time during operation and there will not be any liability what so over arises due to sudden discontinuation of activity. 14) HUL reserves the right of decide the validity of SMS, in case of any confusion or difference of opinion arises, HUL decision will considered final. 15) HUL does not stay responsible for any confusion with respect to ownership of samples within multiple requesters at the venue. Such an issue is expected to be sorted out with mutual understanding within requester. 16) Consumers suffering from any kind of skin or hair related diseases are requested to seek advice from dermatologists or/ and Trichologists and follow the advice for usage of any hair care product. 17) SMS requester need to bare all the charges related to SMS request sent levied by their respective telecom service provider. 18) There is no entry fee for participating in this programme; Participants are therefore cautioned to beware of anyone soliciting payments for entry to this program. 19) HUL reserves the right to alter, modify or change any terms and conditions herein or modify/change, discontinue, terminate, withdraw the campaign at any time during the Campaign Period at its sole discretion without prior notice or assigning any reason. 20) HUL has the right to contact these users anytime after this campaign. 21) All the Sunsilk Products are lab tested and for further details refer to the individual pack. 22) The personal information shared with us, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without the consent of the consumer/ participant, other than for the purpose of sending hair care tips to consumers. 23) All Indian laws and regulations apply. 24) All disputes with respect to this Campaign are subject to the exclusive jurisdiction of the courts or forums in Mumbai only.
1.0 Acceptance 1.1 These Rules and Terms of Service comprises the complete Agreement and Contract between you ("Member") and sunsilkgangofgirls.com (Sunsilk) in relation to the service/s provided by Sunsilk at its website http://www.sunsilkgangofgirls.com ("The Site") and supersedes all previous agreements, contracts and communications (oral or written) in this behalf. By completing the online electronic registration process and clicking the "I Accept" button, you bind you rself to the provisions of these Terms and Conditions of Service.
2.0 Definitions 2.1 Sunsilk 'Gang Of Girls' means the company, corporation, firm, individual or association of persons currently administering, providing content for, maintaining and otherwise managing the Site and every employee of Sunsilk and its advertising agent or agents for the time being and their employees, and every consultant, advisor and associate of Sunsilk and their respective employees. 2.2 "Contest" means any contest, promotion, sweepstakes, lucky draw, or any other scheme by whatever name called involving an element of chance with or without an accompanying test of any skill, aptitude or talent. 2.3 "Contract", "Agreement" and "Terms of Service" refer to the terms and conditions herein set forth. 2.7 "Member" means and includes every person who, having satisfied the Eligibility Criteria set forth herein, has successfully completed the on-line registration process at the site and has been assigned a unique Id by Sunsilk and is not in default and has not committed breach of any of the terms of this Agreement. 2.8 "Personal Information" means all information about the Member provided to Sunsilk via on-line forms at the site or by any other means of communication, whether electronic, oral or written. 2.9 "Site" with all its grammatical variations refers to the web site hosted on the Internet/World Wide Web with the address of http://www.sunsilkgangofgirls.com or such other address as may periodically be assigned to or adopted by Sunsilk. 2.10 "Services" means Sunsilk offers the Member, on an "as-is" and "when available" basis, the opportunity to participate in all contests, promotions, games scheme hosted for the time being on the Site by Sunsilk on behalf of one or more contest providers. 2.11 "Winning" with all its grammatical variations means and includes any prize, cash, gift, exchange coupon or certificate and every other item of like nature that is or may be offered by the Contest Provider as the final result of any Contest hosted by Sunsilk on the Site; and "winner" means a Member who is entitled as the result of any Contest to receive a winning.
3.0 Interpretation 3.1 Words conveying the singular shall, where required or appropriate, be deemed to mean and include the plural. Words conveying the feminine gender shall be deemed to mean and include the masculine gender. 4.0 Consideration for Service - In consideration for this Service, the Member hereby: 4.1 agrees to provide Sunsilk such current, complete, and accurate information about the Member ("Personal Information") as may be required by Sunsilk via the Site. 4.2 agrees maintain and update this information as required to keep it current, complete and accurate. 4.3 agrees and undertakes to maintain the absolute confidentiality of his Id and not to disclose the same to any other person or entity whatsoever at any time under any circumstances and further agrees and undertakes to forthwith notify Sunsilk of any breach of the aforesaid confidentiality, loss, misplacement, theft, misuse or abuse of the Id.
5.0 Right of Modification, Termination and Discontinuance 5.1 At all times, Sunsilk shall have the absolute right to modify, discontinue or terminate the Service without notice to the Member. 5.2 is expressly agreed and understood by the Member that Sunsilk shall not be liable to the Member or to any third party for such modification, discontinuance or termination.
6.0 Right of Termination of Membership 6.1 If, in the sole opinion of Sunsilk, the reasons where for Sunsilk shall not be bound to disclose, the Member has contravened, committed hacking or committed breach of any of the terms of this Agreement, Sunsilk shall be entitled, without any notice, to terminate the Membership of the Member and to revoke his Id. 6.2 It is expressly agreed and understood by the Member that any breach or default by the Member of any of the provisions of this Agreement shall result in the immediate cancellation of his Membership and revocation of his Id without notice. 6.3 Sunsilk and its employees shall at no time be in any way liable or responsible to the Member or to any other person for any such cancellation of Membership and revocation of Id, provided that, Sunsilk shall be entitled to all its rights and remedies against the Member for any loss or damage or prejudice that may have been caused to Sunsilk on account of any such breach or default by the Member.
7.0 Indemnity by Member 7.1 The Member agrees and undertakes to indemnify and hereby indemnifies and keeps safe and harmless Sunsilk from all loss, claim, demand, damage, costs, charges (including legal fees and charges) or prejudice that may be caused on account of the Member's use of the Service offered by Sunsilk at the site. 7.2 The Member agrees and undertakes to indemnify and hereby indemnifies and keeps safe and harmless Sunsilk from all loss, claim, demand, damage, costs, charges (including legal fees and charges) or prejudice that may be caused on account of the Member's default or breach of any of the terms of this Agreement.
8.0 Eligibility Criteria For Contests / Point Redemption 8.1 Every contest hosted by Sunsilk is open to residents of India only. Employees of Hindustan Lever Limited, J W Thompson Associates, BC Web Wise and their family and relatives are not eligible to participate. 8.2 Every Contest hosted by Sunsilk shall also be subject to any local, state, central, federal or community laws regarding the same applicable to every member. 8.3 No purchase of any product is necessary to participate in this contest. You must, however, be a registered user of Sunsilk to participate. 8.4 Multiple entries may be submitted but each Member is eligible to receive only one Prize / Free Gift / Products Samples and any other Incentives that Sunsilk may offer through contest or point redemption scheme. 8.5 In order to be eligible to win a prize, participants must complete the form; incomplete forms will not be accepted. Incomplete entries (without the mandatory particulars) will be automatically disqualified. 8.6 The decision of the judges is final and no correspondence will be entertained. 8.7 Proof of submission of contest entries shall not constitute proof of receipt. 8.8 The organisers reserve the right to determine the delivery arrangements for all prizes. 8.9 Verification of identity is necessary for collection of prizes (i.e. Identity Card must be shown) 8.10 To and fro travel from the place of residence to point of departure from India needs to be borne by the winner. 8.11 All transit risks to the venue of the event will be borne by the winners. 8.12 Acceptance of prizes constitutes permission to the organiser to use the winner's name, relevant details and/or photographs for purposes of publicity, advertising and/or trade without further compensation or notice. 8.13 Hindustan Lever Limited reserves the right to use the names, photographs and other relevant details of the winners in any publicity it issues in conjunction with the Sunsilk promotions. 8.14 All data given by the participant will be used in strict confidence by HLL and will not be passed to any other party. 8.15 Any participant who is suspected of any act of hacking would immediately be disqualified from any ongoing promotion or contest. 8.16 By participating in this contest, participants agree to be bound by the official rules and regulations of the organiser. 8.17 Hindustan Lever Limited is not responsible for the quality & delivery of service during any part of the programme.
9.0 Disclaimer and Limitation of Liability - Subject to any local, State, Federal or other applicable statute - 9.1 All warranties of any kind whatsoever, whether express or implied, are hereby expressly disclaimed by Sunsilk including, but not limited to, meeting of the Member's requirements or aspirations, timeliness, security, uninterruptedness, error-free, the results or reliability of the Contest, or the delivery, quality, quantity, merchantability, fitness for use or non infringement in respect of any goods, services, emoluments, benefits or awards acquired or obtained through the Service or any transactions effected through the Service. 9.2 The Member expressly agrees that this use of the Service provided by Sunsilk is at the member's sole risk and is governed by the terms of this Agreement. 9.3 No advice or information, whether by representations oral, written or pictorial derived from the Site or through the Service shall be construed to mean the giving of any warranty of any kind by Sunsilk. 9.4 At no time shall Sunsilk be liable to the Member or to any third party for the acts of omission or commission hosted by Sunsilk on the Site or for any direct, indirect, incidental, consequential or foreseeable loss, damage, injury, harm, prejudice or costs that that may arise or be caused to the Member by his use of the Service offered by Sunsilk at the Site or by termination of membership as provided herein.
10.0 Winnings 10.1 Intimation that a Member is a Winner of the Contest hosted by Sunsilk will be sent by Sunsilk by email and by the Contest Provider by such mode of delivery as the Contest Provider considers appropriate. 10.2 Where Sunsilk is the Contest Provider its liability is limited to, and only to, assuring the delivery of the winning within a reasonable period of time to the winner and does not extend to any other warranty or assurance whatsoever. 10.3 All winnings will be subject to local, state, federal and central taxes and duties. 10.4 All the selected winners should make themselves available for the specified day of the event. 10.5 All prizes are not transferable, non-refundable and non-exchangeable for cash or other products.
11.0 Interpretation of this Agreement 11.1 The decision of Sunsilk as to the interpretation of any Clause of this Agreement shall be final and binding on the Member.
12.0 Arbitration 12.1 All disputes and differences between the parties hereto including as to the interpretation of any provision of this Agreement shall be referred to the Sole Arbitration of a person nominated by Sunsilk and the provisions of the Arbitration and Conciliation Act, 1996 will apply to such arbitral proceedings.
13.0 Copyright 13.1 Unless otherwise specifically noted, the copyright in all images, text and material on the Site belongs to and vests in Sunsilk. 13.2 Unauthorised reproduction of any text, image or other material without the prior written permission of Sunsilk, in any form whether printed or electronic, is strictly prohibited and violations will be prosecuted to the full extent of the law.
14.0 Applicable Law and Jurisdiction 14.1 This Agreement shall be governed by and construed in accordance with the applicable laws in India . 14.2 All registrants into the site undertake to abide by all the laws of the land. 14.3 Hindustan Lever Limited shall not be responsible for any damages and / or injuries to any persons either directly or indirectly arising out of use of the website and any of it's contents. 14.4 This Agreement shall be deemed to have been entered into Bombay
